Disclaimer and warranty information
Revolutionary Performance and Machine, LLC (RPM) will not be liable to customer for any exemplary, indirect, incidental, special, or consequential damages, including but not limited to loss of anticipated profits or revenues, which arise either directly or indirectly out of RPM’s performance, or out of negligence in the course of such performance, even if RPM has been advised of the possibility of such loss or damages. Any liability for losses arising hereunder shall not, in any event, exceed the amount of fees paid to RPM by customer for goods/services provided.
Some parts may carry a manufacturer's warranty which RPM will assign to customer, as requested. RPM will not independently pursue claims with manufacturers, even if the warranty is not assignable.
Any claim for defects in workmanship must be reported to RPM within 30 days of receipt of product. RPM will inspect the workmanship only upon its premises, as delivered by Customer, and will re-tool equipment and replace any necessary parts only if RPM, in its sole and absolute discretion, determines that the failure was due to defects in RPM’s workmanship.
RPM SPECIFICALLY DISCLAIMS ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED OR ARISING OUT OF THE COURSE OF DEALING OR USAGE OF THE TRADE, ORAL OR WRITTEN, WITH RESPECT TO THE GOODS/SERVICES PROVIDED, INCLUDING BUT NOT LIMITED TO ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THESE REMEDIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER REMEDIES.
REFUNDS - Should a customer wish to cancel an order once deposit has been made, a restocking fee of 25% of the total parts order will be assessed. No refund will be given for any machine work already performed. Should a customer wish to refund an order after completion, a restocking fee of 25% of the entire order cost will be assessed. No refund will be given for shipping costs. Customer is responsible for all shipping costs.
